The Embark Studio at Embark Physical Therapy & Wellness

By booking or attending a class, workshop, or service offered by The Embark Studio at Embark Physical Therapy & Wellness ("we," "our," or "us"), whether in-person or online, you ("you" or "the client") agree to the following Terms of Service and Liability Waiver.

1. Eligibility & Health Disclosure
• You must be 16 years or older to participate in our classes or services, unless attending a designated class for minors and accompanied by a legal guardian.
• You confirm that you are physically able to participate in yoga or wellness activities and have disclosed any relevant medical conditions, injuries, or physical limitations via your MarianaTek account or in writing.
• It is your responsibility to consult a physician before beginning any fitness or wellness program, especially if you have a known medical condition or injury.

2. Acknowledgement of Risk
Yoga, meditation, breathwork, and related wellness activities involve inherent risks, including but not limited to physical exertion, muscular strain, injury, or aggravation of existing medical conditions. By participating, you acknowledge and accept the following:
• You voluntarily assume all risks associated with participation in classes or use of our facilities, whether supervised or unsupervised.
• You release The Embark Studio at Embark Physical Therapy & Wellness, its owners, instructors, staff, contractors, and affiliates from all liability for any personal injury, loss, or damages sustained on or off the premises, including virtual classes.

3. Waiver of Liability
To the fullest extent permitted by the laws of Ontario and Canada, you agree to:
• Waive, release, and forever discharge any and all claims, liabilities, damages, or actions against The Embark Studio at Embark Physical Therapy & Wellness and its representatives resulting from your participation.
• Indemnify and hold harmless the studio and its staff from any claims brought against them by third parties arising out of your conduct or participation.

4. Booking, Payments & Cancellations
• All bookings must be made through MarianaTek, our official booking and payment platform.
• Classes and appointments are subject to availability and may be cancelled or rescheduled.
• Our cancellation policy requires a minimum of 3 hour's notice prior to the start of the class/workshop/event.
• No refunds are provided for no-shows or unused packages, except where required by law.

5. Studio Etiquette & Code of Conduct
By entering our studio or attending virtual classes, you agree to:
• Arrive on time and respect the studio’s quiet environment.
• Turn off mobile devices unless required for emergency contact.
• Refrain from disruptive, disrespectful, or inappropriate behavior.
• Follow all instructor guidance and safety protocols.
We reserve the right to refuse or terminate service to anyone for inappropriate conduct or breach of these terms.

6. Use of MarianaTek Platform
We use MarianaTek, a third-party platform, for class scheduling, payment processing, and client communications. By using our services, you agree to MarianaTek’s Terms of Service and Privacy Policy.

Your personal information is handled in accordance with our Privacy Policy, in compliance with PIPEDA.

7. Online & Virtual Classes
Participation in livestream or on-demand classes carries similar risks as in-studio participation. You are responsible for ensuring:
• A safe, distraction-free space to practice.
• Stable internet and appropriate equipment.
• That your participation remains within your physical limits, especially in the absence of direct supervision.

8. Intellectual Property
All content provided in our classes, on our website, and in our marketing (including class recordings, teaching materials, logos, and branding) is the intellectual property of The Embark Studio at Embark Physical Therapy & Wellness and may not be copied, distributed, or reused without written consent.

9. Modifications
We reserve the right to update these Terms of Service & Waiver at any time. Continued use of our services after changes indicates your acceptance of the updated terms.

10. Governing Law
These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any legal disputes shall be resolved in a court of competent jurisdiction in Ontario.

11. Consent & Signature
By checking the required box on the booking website, booking a service, or attending any class, workshop, or event, you confirm that you have read, understood, and agree to these Terms of Service and Waiver.
